Bush-appointed judge halts Trump travel ban nationwide

A federal judge in Seattle issued a temporary nationwide restraining order Friday stopping President Trump’s executive order banning citizens of seven countries from entering the United States.

Judge James Robart, who was appointed by former President George Bush in 2003, ruled the executive order would be stopped nationwide, effective immediately.

“The Constitution prevailed today,” Washington Attorney General Bob Ferguson said in a statement after the ruling. “No one is above the law — not even the President.”

The most import job a President has is to keep America safe from foreign attacks. Nowhere in the Constitution does it say a person from a foreign country is protected by an American Constitution. This judges action endangers America by allowing ANY refugee that may be an ISIS sympathiser to attack us. So, keep your powder dry boys, you may need it soon.

How about the pardon obama gave Bergdahl the deserter who left his post in Afghanistan and as a result got several people wounded and or killed, where was this self righteous a hole then and that was within the last few weeks? This is why the president has a cabinet. This is why he needs people who understand the law around him not propagandist and PR people. As I say don’t blame judges for stopping a mess made by hast.

    Who does this judge think he is. We did NOT elect this dumbass and he shouldn’t be able to dictate to the President of the United States. I thought it took an action by a majority of judges on the U.S. Supreme Court to do this. The Congress of the U. S. should get involved in this immediately. I think this judge is wrong and I also think President Trump is trying to protect the citizens from the muslim invasion. I don’t think ANY muslim should be able to immigrate to this country because the follow sharia law and will not follow the U. S. Constitution and THAT alone should make them ineligible to enter the United States. What say you other folks?

    matters are Trump’s policies which are often inconsistent with his

There must be no politics when it comes to law and order and adhering to First Amendment protection of religious beliefs whether Christian of Muslim or any other religion. The president, congress nor any other governmental representative must legislate against anyone and their free exercise of religion for travel or other activities in America. Good decisions judges.

We stopped people who have worked with us for years fighting terrorist for the only reason being they are Muslim.             I hate chickens, I had to deal with 40,000 of them for almost twenty years. They are nasty creatures and I rejoice ever time I eat one because there is one less in this world. The entire time growing up on the farm I never had to carry a gun, there was the twelve gauge in the shed if you ran into some egg sucker but the biggest chicken thief was the guy down the road and we weren’t aloud to shot him because his family didn’t want to have to take care of his kids. With all the farmers I have know not one carried a hand gun. They all had long guns for hunting and Thanksgiving day in the afternoon it sounded like a war zone with everybody sighting in their deer rifles. It wasn’t till I moved into the city that I saw any hand guns. The only pistol we had was a 68 caliber tower pistol.

            We had skunks and raccoons. You don’t want to be close to a skunk when you blast it, trust me. The Twelve gauge meant you didn’t miss. We had coops, a thousand or so in each. Times have changed, I keep no livestock, most of the farms in the valley only raise hay or corn. The cows, pigs and chickens are gone and now my neighbors have horses, sheep and alpaca. The old farm houses have been replaced with McMansions. The natural gas boom has made millionaires out of the bigger farmers and even the little guys did alright, up from money of $3000 per acre with about $300 per month per acre once they start production. You won’t find anti fracking people on my road.

            My home sits on top of one of the largest Natural gas pockets in the country. About five miles from my house is the sight of one of the first gas well ever. The locals will say it;s the first commercial well in the country. Even before fracking there were a lot of well around here. The best part is that it’s what they call wet gas that makes it very good for producing plastic. Burning our gas and oil supplies seem stupid to me knowing all the other great thing you can do with it. Personal I think we should buy as much oil from other countries and save our for when they run out. I do like the money though.

The states don’t want it, it cost to much to maintain, the ranchers can’t afford to pay the taxes on it, it’s a lot cheaper to let the feds take care of it and pay a small rent. Over time anything worth having that’s under it will be taken out but there is no hurry. There was a guy who live just over the hill from us when I was growing up. Everyone around him were selling the coal. He sat on his, as he put it it was money in the bank. He did sell a few years later and got about twice what everyone else got. Those resources will still be there if we wait. With time we can even find ways to take them out without destroying the land. Fracking is a good example. The gas well that get my gas is three miles away. You don’t even know they are drilling. Public land is money in the bank.

          1907. Title 8, U.S.C. 1324(a) Offenses

          Title
          8, U.S.C. § 1324(a) defines several distinct offenses related to
          aliens. Subsection 1324(a)(1)(i)-(v) prohibits alien smuggling, domestic
          transportation of unauthorized aliens, concealing or harboring
          unauthorized aliens, encouraging or inducing unauthorized aliens to
          enter the United States, and engaging in a conspiracy or aiding and
          abetting any of the preceding acts. Subsection 1324(a)(2) prohibits
          bringing or attempting to bring unauthorized aliens to the United States
          in any manner whatsoever, even at a designated port of entry.
          Subsection 1324(a)(3).

          Alien Smuggling — Subsection 1324(a)(1)(A)(i) makes it an offense
          for any person who — knowing that a person is an alien, to bring to or
          attempts to bring to the United States in any manner whatsoever such
          person at a place other than a designated port of entry or place other
          than as designated by the Commissioner, regardless of whether such alien
          has received prior official authorization to come to, enter, or reside
          in the United States and regardless of any future official action which
          may be taken with respect to such alien.

          Domestic Transporting — Subsection 1324(a)(1)(A)(ii) makes it an
          offense for any person who — knowing or in reckless disregard of the
          fact that an alien has come to, entered, or remains in the United States
          in violation of law, transports, or moves or attempts to transport or
          move such alien within the United States by means of transportation or
          otherwise, in furtherance of such violation of law.

          Harboring — Subsection 1324(a)(1)(A)(iii) makes it an offense for
          any person who — knowing or in reckless disregard of the fact that an
          alien has come to, entered, or remains in the United States in violation
          of law, conceals harbors, or shields from detection, or attempts to
          conceal, harbor, or shield from detection, such alien in any place,
          including any building or any means of transportation.

          Encouraging/Inducing — Subsection 1324(a)(1)(A)(iv) makes it an
          offense for any person who — encourages or induces an alien to come to,
          enter, or reside in the United States, knowing or in reckless disregard
          of the fact that such coming to, entry, or residence is or will be in
          violation of law.

          Conspiracy/Aiding or Abetting — Subsection 1324(a)(1)(A)(v)
          expressly makes it an offense to engage in a conspiracy to commit or aid
          or abet the commission of the foregoing offenses.

          Bringing Aliens to the United States — Subsection 1324(a)(2) makes
          it an offense for any person who — knowing or in reckless disregard of
          the fact that an alien has not received prior authorization to come to,
          enter, or reside in the United States, to bring to or attempts to bring
          to the United States in any manner whatsoever, such alien, regardless of
          any official action which may later be taken with respect to such
          alien.

          The Illegal Immigration Reform and Immigrant Responsibility Act
          (IIRIRA), enacted on September 30, 1996, added a new 8 U.S.C. §
          1324(a)(3)(A) which makes it an offense for any person, during any
          12-month period, to knowingly hire at least 10 individuals with actual
          knowledge that these individuals are unauthorized aliens. See this Manual at 1908 (unlawful employment of aliens).

          Unit of Prosecution — With regard to offenses defined in subsections
          1324(a)(1)(A)(i)-(v), (alien smuggling, domestic transporting,
          harboring, encouraging/inducing, or conspiracy/aiding or abetting) each
          alien with respect to whom a violation occurs constitutes a unit of
          prosecution. Prior to enactment of the IIRIRA, the unit of prosecution
          for violations of 8 U.S.C. § 1324(a)(2) was each transaction, regardless
          of the number of aliens involved. However, the unit of prosecution is
          now based on each alien in respect to whom a violation occurs.

          Knowledge — Prosecutions for alien smuggling, 8 U.S.C. §
          1324(a)(1)(A)(i) require proof that defendant knew that the person
          brought to the United States was an alien. With regard to the other
          violations in 8 U.S.C. § 1324(a), proof of knowledge or reckless
          disregard of alienage is sufficient.

          Penalties — The basic statutory maximum penalty for violating 8
          U.S.C. § 1324(a)(1)(i) and (v)(I) (alien smuggling and conspiracy) is a
          fine under title 18, imprisonment for not more than 10 years, or both.
          With regard to violations of 8 U.S.C. § 1324(a)(1)(ii)-(iv) and (v)(ii),
          domestic transportation, harboring, encouraging/inducing, or
          aiding/abetting, the basic statutory maximum term of imprisonment is 5
          years, unless the offense was committed for commercial advantage or
          private financial gain, in which case the maximum term of imprisonment
          is 10 years. In addition, significant enhanced penalties are provided
          for in violations of 8 U.S.C. § 1324(a)(1) involving serious bodily
          injury or placing life in jeopardy. Moreover, if the violation results
          in the death of any person, the defendant may be punished by death or by
          imprisonment for any term of years. The basic penalty for a violation
          of subsection 1324(a)(2) is a fine under title 18, imprisonment for not
          more than one year, or both, 8 U.S.C. § 1324(a)(2)(A). Enhanced
          penalties are provided for violations involving bringing in criminal
          aliens, 8 U.S.C. § 1324(a)(2)(B)(i), offenses done for commercial
          advantage or private financial gain, 8 U.S.C. § 1324(a)(2)(B)(ii), and
          violations where the alien is not presented to an immigration officer
          immediately upon arrival, 8 U.S.C. § 1324(a)(2)(B)(iii). A mandatory
          minimum three year term of imprisonment applies to first or second
          violations of § 1324(a)(2)(B)(i) or (B)(ii). Further enhanced punishment
          is provided for third or subsequent offenses.

          any prosecution hereunder for the same act or acts.

          (d)

          Whenever, in the opinion of
          the Attorney General or of the appropriate officer of the Department of
          Justice charged by law or under the instructions of the Attorney General
          with authority to act, any person shall have violated this chapter, the
          Department shall proceed as speedily as possible with a prosecution of
          such person hereunder and with any appeal which may lie from any
          decision adverse to the Government resulting from such prosecution.

          (e)

          Nothing contained in this
          section shall be construed to make it unlawful for any person to travel
          in, or use any facility of, interstate or foreign commerce for the
          purpose of pursuing the legitimate objectives of organized labor,
          through orderly and lawful means.

          (f)

          Nothing in this section shall
          be construed as indicating an intent on the part of Congress to prevent
          any State, any possession or Commonwealth of the United States, or the
          District of Columbia, from exercising jurisdiction over any offense over
          which it would have jurisdiction in the absence of this section; nor

            to incite a riot; or

            to organize, promote, encourage, participate in, or carry on a riot; or

            (3)

            to commit any act of violence in furtherance of a riot; or

            (4)

            to aid or abet any person
            in inciting or participating in or carrying on a riot or committing any
            act of violence in furtherance of a riot;

            who either during the course of any such travel or use or thereafter
            performs or attempts to perform any other overt act for any purpose
            specified in subparagraph (A), (B), (C), or (D) of this paragraph— [1]

            Shall be fined under this title, or imprisoned not more than five years, or both.

            (b)

            In any prosecution under this
            section, proof that a defendant engaged or attempted to engage in one or
            more of the overt acts described in subparagraph (A), (B), (C), or (D)
            of paragraph (1) of subsection (a) [2]
            and (1) has traveled in interstate or foreign commerce, or (2) has use
            of or used any facility of interstate or foreign commerce, including but
            not limited to, mail, telegraph, telephone, radio, or television, to
            communicate with or broadcast to any person or group of persons prior to
            such overt acts, such travel or use shall be admissible proof to
            establish that such defendant traveled in or used such facility of
            interstate or foreign commerce.

            (c)

            A judgment of conviction or
            acquittal on the merits under the laws of any State shall be a bar to
            any prosecution hereunder for the same act or acts.

            (d)

            Whenever, in the opinion of
            the Attorney General or of the appropriate officer of the Department of
            Justice charged by law or under the instructions of the Attorney General
            with authority to act, any person shall have violated this chapter, the
            Department shall proceed as speedily as possible with a prosecution of
            such person hereunder and with any appeal which may lie from any
            decision adverse to the Government resulting from such prosecution.

            (e)

            Nothing contained in this
            section shall be construed to make it unlawful for any person to travel
            in, or use any facility of, interstate or foreign commerce for the
            purpose of pursuing the legitimate objectives of organized labor,
            through orderly and lawful means.

            (f)

            Nothing in this section shall
            be construed as indicating an intent on the part of Congress to prevent
            any State, any possession or Commonwealth of the United States, or the
            District of Columbia, from exercising jurisdiction over any offense over
            which it would have jurisdiction in the absence of this section; nor
            shall anything in this section be construed as depriving State and local
            law enforcement authorities of responsibility for prosecuting acts that
            may be violations of this section and that are violations of State and
            local law.

I knew that wasn’t possible so here is the rest of the story, but you can bet in order to have something to say this is going worldwide.

            Federal Judge Ann Donnelly of the Eastern District of New
            York has handed an early victory to the lawyers challenging President
            Donald Trump’s executive order barring immigrants and travelers from
            seven majority-Muslim countries from entering the US.

            Judge Donnelly announced during an emergency hearing
            Saturday night that she was granting a stay that would prevent the
            government from deporting immigrants currently detained in airports
            around the country. You can read the stay in full here.

            Now, let’s be clear: The stay does not strike down the
            full executive order. It does not allow people to come to the US who are
            currently abroad. What it does is “preserve the status quo” for people
            who came to the US in the immediate aftermath of the executive order,
            after having been granted visas allowing them to legally come to the US
            (before the order was signed).

            That means it prevents the hundreds of people
            detained at airports Friday and Saturday from being deported, while the
            court system susses out whether Trump’s executive order was in fact
            legal.

            Donnelly ordered
            that the federal government was restrained nationwide from “in any
            manner or any means removing” people with previously approved refugee
            applications, holders of valid immigrant and non-immigrant visas, and
            other individuals from the seven countries named in the executive order.
