Obama could still force Garland onto court during ‘intersession recess’

garlandresident Obama will have one last chance to force Judge Merrick Garland onto the U.S. Supreme Court on Tuesday — but it’s a legal gamble and one that has so many pitfalls that even those who say he could get away with it believe it isn’t worth the fight.

Mr. Obama’s moment will come just before noon, in the five minutes that the Senate gavels the 114th Congress out of session and the time the 115th Congress begins.

In those few moments the Senate will go into what’s known as an “intersession recess,” creating one golden moment when the president could test his recess-appointment powers by sending Judge Garland to the high court.

    If President Obama pulls this stunt, Merrick Garland should be impeached and removed from the bench completely. Once that is done Kagan and Sotomayor should be the next in line to be impeached and removed from the bench. President Obama has consistently sought to destroy and undermine the Constitution. It’s time to reverse this lawless man’s actions.

    President Obama has turned the judiciary into a make-a-wish foundation for liberal activists. We need to clean house on the Supreme Court and the courts of appeals. Once new judges are in place they need to start reversing many of the bad court decisions of the past. Some of the candidates for repeal include: Roe vs. Wade, all the gay marriage decisions, all the decisions against the Ten Commandments and Bible in government and in schools.

    The Constitution wisely blocks the ability for a president to act as a king. Obama needs to understand that he is pushing his luck and the more he pushes it in the waning days of his administration the better the chances it will all be reversed.

    Pres. Obama’s no fool. If it’s feasible, will save the Court from a hard right swing under Trump and Republicans can’t thwart the recess as they’ve done before, it will be done. The current President knows now his legacy is in the toilet with congress and presidency lost to Republicans due to his reticence announcing Russian hacking of the election campaigns, so this is a final chance for salvation. Dems in congress have not blasted loose the required hearings or vote for Merrick Garland to get him confirmed traditionally, so a non-traditional move like recess appointment is the last straw, if he’ll take it.

            It’s really Republicans who worry about partisanship on the courts. Judges are pretty evenhanded when considering the law, facts and precedent. I’d call it evenhanded when Chief Justice found Obamacare enrollment requirements to be constitutional. It is primarily Thomas and formerly Scalia who are the partisan Republicans, not so much on the left. I prefer expanding individual rights and freedoms; so do ‘Democratic’ Justices; not so much for Republicans. Look at the record, not partisan boilerplate from McConnell.

            Meanwhile Republicans in the Senate violate their constitutional duty to advise and consent over Merrick Garland’s nomination. Explain that away without partisan rhetoric.

            Moreover, in your stated beliefs, there is no provision for the senate to reject nominees, as “advice” does not connotate “discussion” with the president on his choice. Can you cite ANY such one-on-one (senate-to-POTUS) discussions, Bill?

            Then there’s the word “consent.” Where is the option of “non-consent” in your version of constitution interpretation?

            In the literal version of your interpretation, it was/is the senate’s responsibility to “rubber-stamp” whoever the POTUS wants for SC justice.

            And it has NEVER been that way: starting with John Quincy Adams’ nomination of John J. Crittenden for SC justice. The 20th Senate chose to take no formal action on his nomination – just like the 115th Senate has done with Garland.

            And that “non-action” happened over 20 times since the Crittenden non-action.

            To make a nation certain common cultural events are necessary–education is one. Within that broad understanding, individual States are responsible for education of their citizens. So States choose or reject federal suggestions for goals and objectives, curriculum and methods that give us a common heritage. The president only chooses top education officials and ‘common core’ was developed by them and specialists in education and subject matter for consideration. You by contrast refer to common culture as ‘dumbing down the system’, a certain amount of which must happen as our students have vastly different aptitudes, abilities, backgrounds and cultures including parental concern that influence schooling–literally thousands of factors which are hardly dumb. You spew a quite limited view of schools which have led America to pre-eminence in the world of education at the graduate level. Youths from around the world come to us for our advanced education, hardly seeking ‘dumbness’. Get a little understanding if not education before you make yourself look so ‘dumb’ yourself about schooling.

            A little knowledge is a dangerous thing. I’m watching Trump with his nonsense, but you are right there too. Our education is not class based like others; neither are there arbitrary blocks to advancing to one’s level like most nations. Our elementary and secondary education accounts for the wide range of student needs not considered abroad. Meanwhile checking the Occupation Outlook handbook shows we account for talent, ability, interests, individualism that aren’t part of foreign systems. So grades reflect that and that we educate everybody, not just some elites. I do agree that Bush2 dumbed down curriculum and set unattainable goals for schools and students. Common Core does not but some of you can’t be convinced from the bad example set earlier. FYI many federal grants carry conditions for spending money, called federal compliance. It’s still up to local and State officials to apply and use the money by following guidelines. If you have trouble with this concept, talk to your elected officials who control the bureaucrats that make the choices.
            Also, FYI there are standards and norms for communications at all levels that you want to ditch with Trump. It can lead in his case to jeopardy and reduced security for America. If Trump favors Putin, don’t you think the Ruskies will try invading another country hoping for no retribution. You are very naïve about dealings with others perhaps based on a narrow fact base with marginal understanding not from your own thinking.

            First of all for lack of a more precise way of saying it our elhi schools are mainly child processing factories. Part of that is because of the system that was adopted in order to teach children. Part of that is also the fault of teacher unions as they put students in a disadvantaged position in relation to teachers. What they say does not equal what they do.
            I personally am a big fan of block grants to states when it comes to education. To put it simply the Dept. of Ed. should just write out 50 checks to the states and that is it. No holding back of funding for any reason since the money originally is the parents’ as well as there will be no handling fees involved by the absence of the bureaucracy involved.
            Your feeble excusing of the dumbing down of educational levels is pretty sad. Acceptance is not an option nor an answer. I can tell you that educating people to the lowest common denominator is an exercise in futility. You should admit to effect the children of illegal immigrants has on the level of education children get nowadays. Diversity may be great but it comes with a cost that progressives can’t sell so they hide it.

            At the university level we do indeed hold preeminence. but in primary and secondary education we suck. That might explain why in some university STEM programs more than 90% of the students are foreign. 70.3% of all full-time graduate students in electrical engineering, 63.2% in computer science, 60.4% in industrial engineering, and more than 50% in chemical, materials and mechanical engineering, as well as in economics (a non-STEM field).

            In theory primary and secondary education is a state issue, but in fact the feds have enormous influence, and worst of all the teachers unions have de facto control.

            NEA and ACT are responsible for not only dumbing down the students, but the teachers as well.

            The U.S. Department of Education isn’t very old. How do you explain things before Carter’s time?
            What’s dumbing down students is our requirement that all children must attend school. We take everybody to the limits of their abilities and interests, without socioeconomic factors involved in public schools, except for teacher quality today. You give the unions too much credit. State and local school boards make all the decisions, not unions. You are parroting the party line, the anti-intellectual line here.

            I have personal experience, that even in a right to work state, the unions put up so much of an impediment to firing a teacher that it takes years and often hundreds of thousands of dollars, which most districts are willing to do.

            Before Carter our ranking was much higher. The NEA changed to a labor union in the ’60s when they merged with the ATA. I believe it was NEA President Lois Edinger, who said then at the convention that teachers had to shift their focus from academics to socialization.

            And our educational quality started an immediate decline. Academically a Ba in 1999 was almost exactly the same as a high school diploma in 1959.

            By the way, when you see a yard sign or billboard advertising to elect someone to a school board, odds are that the signage was paid for with a campaign donation from the teachers union.

            A primary function of unions beyond payscales is working conditions. In the 1950s we still had garment sweatshops employing young girls for exorbitant hours and tiny wages. You prefer that kind of country?
            In teaching we have human personalities involved all principals and teachers having foibles. Workers need protection against the power of managers. That’s why I was a contract provision writer, grievance agent and school representative for a big city or two. Who alone could stand against a school board, several levels of superintendents and supervisors and department head?
            Union presidents come and go; some good, some bad. I did my work regardless for no pay and little thanks from anybody due to believing in people before systems.
            I don’t know where you get the bachelors and diploma equivalence, but it’s true in some cases in my experience.
            Maybe you are a laborer or operator, a working class stiff. Unions declined in proportion to worker wages since Reagan times. That means your wages stagnated while jobs disappeared with automation. That’s a good reason to back unions, to protect jobs and wages/benefits. Many Trump supporters with Obamacare and skilled jobs will come to appreciate unions with Republicans deregulating everything; they CEOs have already absorbed most corporate income increases and half the world’s assets. Do you approve? Vote for unions, if not.

            Like FDR though, I have every problem with public employee unions. When the school board is made up of members beholden to union campaign donors and the principles, department heads etc are union members, it’s the kids (and parents) who take it up the rear. As Albert Shanker, president of the AFT famously said, “When school children start paying union dues, that ‘s when I’ll start representing the interests of school children.” and also “It’s time to admit that public education operates like a planned economy, a bureaucratic system in which everybody’s role is spelled out in advance and there are few incentives for innovation and productivity. It’s no surprise that our school system doesn’t improve: It more resembles the communist economy than our own market economy.”

            The bachelors and diploma equivalence comes from a 2002 Harvard study.

            Unions are directly responsible for much of the automation in industry.

            Re unions, do you seriously think private employees have different problems with pay and benefits than private industry??? Unions of workers against managers with so much power to hire and fire need a unified voice to maintain balance–namely unions.
            I don’t know of any school board members beholden to donors who affect votes anywhere but the largest cities. My own dad was a school board member and spent no personal cash running. You should look into your ‘charges’ before generalizing to all size units.
            I’ve been a member of both teacher unions occasionally and actively supported, worked for them. They are not the ‘evil’ empires you imagine. Pay and benefits for public and private workers are always under assault by managers seeking to minimize budgets or oppress individuals. They need an equivalent voice with power. You put your finger on one reason wages of middle class workers have stagnated for a generation. Union bashing.
            Every large public function has an element of control–necessary to carry out its aims. It’s not communist but bureaucratic–big difference. You should study the differences before criticizing.
            Now due to pressures by people like you to increase international/national test scores, much freedom of action, called classroom autonomy and academic freedom, is gone. That means upper middle class people, especially women, don’t become teachers like past generations. Exorbitant energy and effort spent toward improving test scores has taken valuable instructional time away from classrooms. My own district used testing as benchmarks, not teacher pay guides, for curriculum improvement and teacher hiring based on solicited community/parental goals we got through public coffee series. 25% of my seniors topped out on the test at graduation. Nobody was graded like current oppressive programs, no paychecks were cut for low test results like now. That’s accountability.
            Student outcomes vary with socioeconomic status, so it’s possible one community or two might meet your ‘Harvard study’ conditions, not generally. That’s called democracy where States control.
            Actually automation in teaching is counterproductive. I studied the differences and rejected programmed instruction replacing teaching.

            I know of three school board members that are funded by the union. As I said, you can usually tell by the campaign signs.

            The rise of teachers unions has been almost perfectly inversely proportional to the decline in educational quality. Doubtful that’s a coincidence.

            Or (as I’ve related before) when we passed a teacher competency law in NM mandating that public school teachers had to be able to pass the tests given to kids they taught, 25% failed after 3 tries…get that…1/4 of the teachers teaching elementary, middle, and secondary schools couldn’t pass the same tests given at the grade level they taught .

            Lest you think that at least we had gotten rid of a bunch of incompetent teachers, 100% of those teachers were “grandfathered”, explicitly because it would take more time and money than the state could afford to fight the teachers unions.

            I don’t know NM education aside from many Hispanics and Indians. In my Deep South City, 10% of teacher graduates from certain (not all) colleges failed Praxis testing for beginning teachers. That middle class biased test failed to measure middle class black achievement and knowledge just like the SAT had cultural biases for years. It didn’t mean they weren’t good teachers as I worked with many.
            Plus you overlook the specialization that occurs in subject matter courses that isn’t reflected in general testing for credentials or anything else. You ask for expertise in everything under a subject heading, something that’s accounted for by appropriate placement in the departments. It’s not incompetence as you pretend.
            Admissions testing was determined by school boards, not unions. You imagine far more negativity than exists. Go into the schools, attend a school board meeting, join a PTA and see reality. Your are quite the curmudgeon in things.

            My 8th grade nephew (who I raised) asked me if fish were amphibians, and claimed that his teacher had taught they were. I told him he must have misunderstood her. He got his best friend to bring over his notes and homework to prove it.

            I called the principal and on Monday met with the teacher and principal in his office where she asserted that fish WERE amphibians. The principal said he would take it to the board.

            She was kept in the same class, and after several more instances of incompetence, I and several other parents went to the school board and brought it to them directly. They thanked us and said they would investigate. They decided on no action.

            The president of the board (a friend of mine) told me later that no action would be taken because it would take as much as 5 years and $100,000 or more in legal fees to fire her because of the union, and we just didn’t have the money (VERY small district, k-12 less than 300 students total).

            A couple of years later she wanted to get married and move to Soccorro and was given a glowing recommendation on order to get rid of her.

            This was apparently quite a common method of “firing” a teacher according to my friend on the board, saving tons of time and money.

            No, I’ve never had a problem working with unions and their representatives. In fact their leaders were pretty much always consulted in planning. What you forget is that unions don’t protect incompetent or criminal teachers, a common misconception on the right. What’s true is that supervisors and principals fail to develop the legal reasons/briefs or don’t want to be seen as anti-teacher. Its a management problem.

Your link is valid, but you must remember that few administrators or boards want to fire a teacher whose entire career may then end. This is not the sentiment I hold, and no place had the problem this link shows. It’s an exception that may not exist today from that very link’s statements.

            Thanks for the history breakdown. Education was made a Cabinet level Secretariat in 1979 under Pres. Carter. Public schools date back to the post-Civil War era when factories needed interchangeable workers to run the machinery. Public training was the order of the day.

          Obama says he didn’t impose sanctions before in order not to influence the election, but everybody knew that the emails were stolen and leaked, and all of the Democrat talking heads were blaming it on Russia for weeks before the election.

          “Romneycare” does have similarities to Obamacare, but it depended on what amounted to federal subsidies. Obamacare doesn’t have a higher source of funding. You can’t “inflate it to national status” without having that superior funding source.

          The “good parts” were always a part of the Republican alternatives. It’s too bad the Democrats decided to pass Obamacare without any discussion or debate with Republicans, we would have a bill that “belonged” to both sides, and both sides would have an interest in fixing any deficiencies.
