SCOTUS-DissentSupreme Court Justice Antonin Scalia and his conservative colleagues may have been overruled in Thursday’s decision upholding ObamaCare subsidies, but they didn’t go down without a fight.

The firebrand conservative justice delivered one of the most scathing and linguistically creative dissents in recent memory. In a 21-page rebuttal, Scalia and two other justices tore into the Affordable Care Act and the court’s handling of it over the years — effectively accusing their colleagues of twisting the law for the sake of preserving President Obama’s signature policy.

“Today’s interpretation is not merely unnatural; it is unheard of,” Scalia wrote, joined by Justices Clarence Thomas and Samuel Alito.

    That’s what Chief Justice Roberts emphasized. PPACA was not infringing on or dismantling Health care for members or harming the Insurance providers. The act was a win-win for every stakeholder and those currently restricted should benefit by participating as well.

    The GOP 67 attempts to dismantle Obamacare cost the U.S Treasury over 25 million dollars at one period and more as they fail to come to terms with the health care law of the land. Stop wasting taxpayers money that you fail to fairly pay your fair share into anyway.

    I am most definitely not impressed by the majority decision of the SCOTUS. I was not happy with the administration. Then, I added the congress to that list for lack of spine. Now, I double down in my disdain by including SCOTUS. It seems it will require massive organization at the grass roots to throw these bums out and elect some new “bums”.

            Don’t turn things upside down and claim a lie is the truth. There are many people that believe as I do, but that is hardly the important thing. There is a good, true and right side on the issue and liberals, generally, think there is no God, no right or wrong, and somehow “they” are going to run and control everything. PPACA institutionalizes corporatism and crony capitalism and true conservatives want freedom of information and smaller government.

    Beginning yesterday and continued today; the Supreme Court struck the final blow against our system of checks & balances as they by their decisions moved into the Legislative realm. Gone are the days when the Constitution mattered and Statutory Law was the guiding principle. What remains is a Totalitarian State where the only decision makers for our society are those who have the authority and power to enforce their decisions. AMERICA should be very afraid!!

            I saw where you wrote that you believe in God and preach on Sundays. So, I’m sure you know Prov. 14:12. You also should know Isaiah 1:18 which has YHWH inviting us to use reason. Based on this, I invite you to think about the SCOTUS decision from both sides and understand what is happening in this decision. This decision reflects serious apostasy within this nation and should be ignored by genuine Christians. Indeed, it should be ignored by every thinking person.

There is also a easy way and a hard way that requires hard work and self sacrifice, all should be seriously considered, before a choice is made. If you have a close relationship with God the choice and path taken are always correct.

            Let’s cut through the chase and know this about PPACA that should be of interest to you:

            PPACA: [There was a lot of drama before this. But here’s a short version]

            Section
            1312(d)(3)(D) (enacted as public law 111-148)
            Congressman’s chronology:

            To clarify, this section requires Congress and its staff to purchase their health insurance through an Exchange at full price. Bye! Bye! subsidy………

            Section 1312(f)(2)(B)(ii)

            States that large employers are not eligible to purchase a group plan on the Exchange until 2017. Therefore, Members of Congress and their staff are required to pay the entire cost of
            their health care, at least until 2017.

            Senate Bill 1497:

            “No Exemption for Washington from Obamacare Act.” His bill would reverse the Office of Personnel Management(OPM) rule and require the President, Vice President, executive branch political appointees, and all Members of Congress and their staff to purchase health insurance through the Exchange and without subsidies from the Federal Government. Result:$1 (B) savings over ten years.

            Story gets better:
            In order for legislation to be brought to the floor of the Senate, it must be approved by the Senate Majority Leader, Harry Reid (D) Nevada. The bill was a rider on another bill [Energy] and Harry wasn’t buying it, and didn’t.

            So It became a standalone bill. But, Senator Reid has dismissed the bill about a half-dozen times. Anyway, why would anyone in Congress support a bill to eliminate their existing coverage
            and employer subsidy, forcing themselves to purchase insurance through the Exchange?

            Since a private-sector employer can decide not to insure some of its employees or their spouses, and since this would require them to purchase health insurance through the Exchange, then why shouldn’t Congress be subject to the same rules? After all, they are required to purchase their insurance through an Exchange, without subsidies, as it is written in the original bill which no one read and a majority signed.

            Here’s the bottom line. If the PPACA is such a good program, and if, as President Obama mused how it would provide greater access to health care and reduce the growth in health care spending in the U.S., should Washington be required to abide by the original law? Should Congress be required to purchase their insurance the same way as millions of Americans?

            Chapter 89 mandates that OPM comply with certain rate and benefit requirements for the plans it approves and subsidizes; PPACA imposes different rate and benefit requirements on the plans offered through exchanges. OPM thus cannot use its authority under chapter 89 to approve and subsidize a plan selected through an exchange without violating the rate and benefit requirements of at least one of the statutes.

            This is not politics to me. You forget, I’m a Human Resource and Industrial Relations Analyst by profession. Anyway on the ‘Nolan Scale’ I test out, right down the middle.

    The Supreme Court has ceased being a court of law and has become the third branch of government legislating law. Of course this is in violation of the Constitution of the United States, which they swore an oath to support and protect, so if their word is their honor, that makes them dishonorable men and women. Thomas Jefferson said “When injustice becomes law, then rebellion becomes duty.” Guess what!! Injustice is becoming the law.

    Our Supreme Court system has become the opposite of what the founding fathers of the United States had envisioned. The intent of the founding fathers, knowing that politicians would attempt to overreach their authority, tried to establish an unbiased referee, who had no (zero) political loyalty to any political party, and who could review legislation to determine whether it conformed to constitutional requirements. They were to be the third arm of government with the authority to uphold or strike down legislative laws on the basis of whether they complied with the United States Constitution. The Supreme Court does not have, and never has had, the authority to re-write any law. They are not legislators! Their only authority is to review the language of a law to determine whether or not it conforms to the standards set forth in our United States Constitution. In the present case, as well as many others in the past, the Supreme Court has exceeded it’s authority, and has entered into the authority given exclusively to the Congress of the United States. Congress now must act to save their own authority from being overtaken by an unelected, political, and unethical body of our government acting without Constitutional authority.

        Here’s one you may not know. Boehner made a reported $8 million on ACA after congress passed a law whereby members of congress are exempt from being prosecuted for insider trading. That one has been kept very quiet.

      It’s a case of the lib members of SCOTUS back to their old tricks of legislating law rather than doing the only job they were granted of merely interpreting the Constitutionality of laws passed by legislative bodies. Their ruling changes nothing on BOcare.. Congress can still repeal it if they will. We have now learned however that GWB appointee Roberts is no Conservative interested in the plain English laws are written in. He was more interested in correcting the errors the drafters made in the abomination they hastily put together before anyone could read it.
