Democratic mayors in so-called “sanctuary cities” are poised for a major clash with President-elect Donald Trump as city officials from Los Angeles to Washington vow not to cooperate with his administration on deportation orders for illegal immigrants.

Trump’s election has spurred mayors and police chiefs in nearly a dozen major cities to re-affirm their “sanctuary” status, putting them in direct conflict with Trump’s immigration enforcement push — and effectively daring him to slash sanctuary-city funding as he promised during the campaign.

“To all those who are, after Tuesday’s election, very nervous and filled with anxiety as we’ve spoken to, you are safe in Chicago, you are secure in Chicago and you are supported in Chicago,” Mayor Rahm Emanuel said during a press conference. “Chicago will always be a sanctuary city.”

Emanuel joined officials in New York; Seattle; Boston; San Francisco; Los Angeles; Oakland, Calif.; Providence, R.I.; Santa Fe, N.M.; Denver; and Washington, D.C., in saying they will maintain their sanctuary status.

Emanuel also shrugged off Trump’s call to cut funding.

“I would say to the president-elect, that the idea that you’re going to penalize Boston, New York, Los Angeles, Chicago, San Francisco, Philadelphia — these are the economic, cultural and intellectual energy of this country,” Emanuel said in a radio interview.

    The last thing we want is to send Federal troops into our cities. We want cities and states to have more power over themselves with the Federal government having less power and less financial support. Allow cities and states to make decisions about illegal aliens for themselves without any support from Federal funding and Mayors will soon be turning over illegal aliens for deportation.     (a) Criminal penalties

    (1)

    (A) Any person who—

    (i) knowing that a person is an alien, brings to or attempts to bring to the United States in any manner whatsoever such person at a place other than a designated port of entry or place other than as designated by the Commissioner, regardless of whether such alien has received prior official authorization to come to, enter, or reside in the United States and regardless of any future official action which may be taken with respect to such alien;

    (ii) knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, transports, or moves or attempts to transport or move such alien within the United States by means of transportation or otherwise, in furtherance of such violation of law;

    (iii) knowing or in reckless disregard of the fact that an alien has come to, entered, or remains in the United States in violation of law, conceals, harbors, or shields from detection, or attempts to conceal, harbor, or shield from detection, such alien in any place, including any building or any means of transportation;

    (iv) encourages or induces an alien to come to, enter, or reside in the United States, knowing or in reckless disregard of the fact that such coming to, entry, or residence is or will be in violation of law; or

    (v)

    (I) engages in any conspiracy to commit any of the preceding acts, or

    (II) aids or abets the commission of any of the preceding acts,

    shall be punished as provided in subparagraph (B).

    (B) A person who violates subparagraph (A) shall, for each alien in respect to whom such a violation occurs—

    (i) in the case of a violation of subparagraph (A)(i) or (v)(I) or in the case of a violation of subparagraph (A)(ii), (iii), or (iv) in which the offense was done for the purpose of commercial advantage or private financial gain, be fined under title 18, imprisoned not more than 10 years, or both;

    (ii) in the case of a violation of subparagraph (A)(ii), (iii), (iv), or (v)(II), be fined under title 18, imprisoned not more than 5 years, or both;

    (iii) in the case of a violation of subparagraph (A)(i), (ii), (iii), (iv), or (v) during and in relation to which the person causes serious bodily injury (as defined in section 1365 of title 18) to, or places in jeopardy the life of, any person, be fined under title 18, imprisoned not more than 20 years, or both; and

    (iv) in the case of a violation of subparagraph (A)(i), (ii), (iii), (iv), or (v) resulting in the death of any person, be punished by death or imprisoned for any term of years or for life, fined under title 18, or both.

    Encouraging and Harboring Illegal Aliens

    It is a violation of law for any person to conceal, harbor, or shield from detection in any place, including any building or means of transportation, any alien who is in the United States in violation of law.16 Harboring means any conduct that tends to substantially facilitate an alien to remain in the U.S. illegally.17 The sheltering need not be clandestine, and harboring covers aliens arrested outdoors, as well as in a building. This provision includes harboring an alien who entered the U.S. legally, but has since lost his legal status.

    An employer can be convicted of the felony of harboring illegal aliens who are his employees if he takes actions in reckless disregard of their illegal status, such as ordering them to obtain false documents, altering records, obstructing INS inspections, or taking other actions that facilitate the alien’s illegal employment.18 Any person who within any 12-month period hires ten or more individuals with actual knowledge that they illegal aliens or unauthorized workers is guilty of felony harboring. 19

    It is also a felony to encourage or induce an alien to come to or reside in the U.S. knowing or recklessly disregarding the fact that the alien’s entry or residence is in violation of the law.20 This crime applies to any person, rather than just employers of illegal aliens. Courts have ruled that “encouraging” includes counseling illegal aliens to continue working in the U.S. or assisting them to complete applications with false statements or obvious “errors”.21 The fact that the alien is a refugee fleeing persecution is not a defense to this felony, since U.S. law and the UN Protocol on Refugees both require that a refugee must report to immigration authorities “without delay” upon entry to the U.S.

    The penalty for felony harboring is a fine and imprisonment for up to five years. The penalty for felony alien smuggling is a fine and up to ten years imprisonment. Where the crime causes serious bodily injury or places the life of any person in jeopardy, the penalty is a fine and up to 20 years imprisonment. If the criminal smuggling or harboring results in the death “of any person,” the penalty can include life imprisonment. Convictions for aiding, abetting, or conspiracy to commit alien smuggling or harboring, carry the same penalties. 22 Courts can impose consecutive prison sentences for each alien smuggled or harbored.23 A court may order a convicted smuggler to pay restitution if the alien smuggled qualifies as a “victim” under the Victim and Witness Protection Act.24

    Conspiracy to commit the crimes of sheltering, harboring, or employing illegal aliens is a separate federal offense punishable by a fine of up to $10,000 or five years imprisonment.25

    Summary

    A person (including a group of persons, business, organization or local government) commits a federal felony when he:

    assists an alien whom he should reasonably know is illegally in the U.S. or who lacks employment authorization, by transporting, sheltering, or assisting him to obtain employment,

    encourages that alien to remain in the U.S., by referring him to an employer, by acting as employer or agent for an employer in any way, or

    knowingly assists illegal aliens due to personal convictions.

    Penalties upon conviction include criminal fines, imprisonment, and forfeiture of vehicles and real property used to commit the crime.

    Anyone employing or contracting with an illegal alien without verifying his work authorization status is guilty of a misdemeanor. Aliens and employers violating immigration laws are subject to arrest, detention, and seizure of their vehicles or property. In addition, individuals or entities who engage in racketeering enterprises that commit (or conspire to commit) immigration-related felonies are subject to private civil suits for treble damages and injunctive relief.

            There is some kind of MISCONCEPTION here. U.S. law prohibits discrimination. People could not be stopped and questioned because of the color of their skin or the way they look. You or your daughter can hire a lawyer and sue them in court. Sheriff Arpaio is a patriot and a good law enforcement officer who serves his community well.             You understand that we just had an election were people voted and those votes were counted. This isn’t some poll of a few hundred people but the real thing. No one is making up numbers and as the last of the votes are being counted Clinton’s lead in the popular vote is growing. Trump won the electoral college and there for he is our President. This wasn’t a slam dunk it was a very close call. Trump won only because the system gave it to him. Had it been the other way around you would have been screaming bloody murder about the rigged system.

Republicans added to their mid-term gains in state legislatures by adding 5 state house chambers. While Democrats control was reduced to levels not seen since the Civil War. Republicans are now in control of a record 68% of the 98 state legislative chambers…more than twice the number of Democrats. GOP will control both legislative chambers in 32 states while Democrats were only able to muster 13 state legislatures. In 24 of the 32 states with Republican controlled legislatures the voters also elected Republican Governors.         Lets see, we had a 54% turn out, one the lowest for a presidential elections in a long time. Trump got 47% of the vote so 27% of the registered voters voted for him. He didn’t even win the popular vote. The Senate has a very very small majority and because of that the Democrats can block votes. If you have ever read the constitution you will see that spending money is solely their power, the power of the purse. A congressman only need answer to those that voted for him. As long as his voters are happy will him he will keep his job. How do you think Cruz is still in office. You also seem to think that cities get a bunch of federal money. This isn’t the case. Most of the money that the federal government doesn’t spend directly goes to the states to spend. Very little money will be lost by those cities and protecting those people might well be worth it to them. After all just being in this country illegally is a misdemeanor, the same level of crime as a speeding ticket.

They can pilfer their own taxpayers to pay for their lawbreaking. No battle is needed. We need to build walls around the sanctuary cities the see how long they last, how long they hold to their misguided and self-destructive philosophy..

          The term is Posse Comitatus. and yes the President can use it but there are limits to it’s use. Because the violation of our immigration laws are about as low a violation you can get, calling out the guard is a little extreme. Until Congress fixes the law so that the crime more then a parking ticket there is not much the President can do.

            Actually, the Guard could be used because they are “State” Troops. Posse Comitatus would only apply if they came under federal control. If the Governor called them out for local law enforcement, they could handle that. This being said, I agree it would be over kill.

            The thing is we need immigration reform. The laws are just plan bad. Three years ago the Senate passed a pretty good bill, it included most of what the right has been calling for and only gave a right to apply for citizenship on a very limited bases and only after the borders were secured, for those here illegally. It could have very well passed the House which is why they never took it up. Trump has made a lot of noise about what he will do but in reality it’s Congress that has to act. ICE only has 20,000 employees to handle customs, immigration and enforcement. One of the reasons Obama took the actions the way he did was because Congress would give him the money to do it right. The big Question is will Congress work with Trump and can the problem be solved with out destroying the economy. We have 8 million workers that are doing many jobs that no one else wants. For our economy to grow we need a expanding work force and sending to many of these people home could have real consequences. We don’t need quick action we need a real and lasting solution.

I would state that people would do the jobs, but not for the money people can get away with paying illegals under the table. It cracks me up to hear builders in CA state that doing away with the illegals would add X% to the cost of every house. That removing illegals from agriculture jobs would add X% to the cost of food. My question is this: Why? If you are paying minimum wage to an illegal, would not the same minimum wage have to be paid to a “legal” worker? How would this add costs? In building, are you paying good union wages to the illegals who are doing the jobs? If not, are you charging the developer like you were, and pocketing the difference? My belief is that illegals are paid less than “legals” because they (a) need the job and (b) are afraid to complain.

            You would think you are right till you go out a look around. I have talked to contractors who have been forced to us illegals because they can get anyone else to show up after the first day. The work is just plain hard. He pays very well and can get all the people he wants for one day but once they find out that it’s real work the aren’t interested. We have a record number of help wanted ads right now. Walmart is putting in self service registers not to save money but because they just can’t get workers even at $13 per hours. As far as work force participation it’s not just people sitting at home having given up looking. We have an ageing population, the baby boomers are retiring. We have people staying at home to take care of children because daycare costs are so high if they do go to work they don’t make enough to be worth it. There are also people, women in most cases that believe that staying home and taking care of their family is a good thing. The present rate is only 5% less the the highest it ever was. That mean that about 5% more people have chosen not to work then at the peak employment . It’s still higher then it ever was until the late 1970’s. I guess people before 1980 were just plain lazy for not running out and getting jobs. One last thing about the illegals in the work force, the number is less then half what it was back just 15 years ago.

          The PCA could be suspended But if it was it would violate much of what our founding fathers believed in. One of the complains against the King we the use of troops to enforce civil law. Because of our history it would pretty much take an act of insurrection for a president to suspend it. Congress would most likely need to approve the act also. Two basic rules of law are Corpus Delicti and Posse Comitatus.
